0. Important Notice (Verification Is Not a Guarantee)
AgeEvidence provides identity and age verification tooling. Verification involves automated and manual checks and can produce false positives and false negatives. We do not guarantee that any Verification Result is accurate, complete, or sufficient for your legal or regulatory obligations.
You (the business customer) are solely responsible for determining applicable legal requirements, configuring the Services appropriately, and making all access decisions (e.g., whether to grant or deny access to your content or services).
1. Parties and Acceptance
These Terms of Service ("Terms") govern access to and use of AgeEvidence's services, APIs, SDKs, hosted verification flows, dashboards, and documentation (collectively, the "Services").
These Terms form a legally binding agreement between (i) the entity operating AgeEvidence identified in an order form or on the website ("AgeEvidence," "we," "us") and (ii) the business entity using the Services ("Customer," "you").
If you accept these Terms on behalf of an organization, you represent that you have authority to bind that organization.
2. Definitions
- "Customer" means the business entity integrating or using the Services.
- "End User" means an individual being verified on Customer's behalf.
- "Verification" means a workflow intended to check identity and/or age.
- "Verification Result" means a status, score, decision, reason code, or output produced by the Services.
- "Customer Data" means data Customer submits to the Services or instructs AgeEvidence to process.
- "Order Form" means any plan, statement of work, or commercial agreement referencing these Terms.
3. Business Customers Only; End Users Not Parties
The Services are offered to business customers only. End Users do not become parties to these Terms. End Users are presented a verification notice and consent during the verification flow (or via Customer's UX), and Customer remains responsible for End User relationships and decisions.
4. Service Description (Verification Levels)
The Services may support the following Verification levels (depending on configuration):
- full_kyc: identity verification intended for creator KYC and record-keeping workflows (manual review included)
- full_age: strong age verification using government ID (manual review included)
- age_only: age assurance via face age estimation (auto-decision with manual review for borderline cases)
Customer acknowledges that age_only is not document-based identity verification and may not satisfy jurisdiction-specific requirements for pornography access controls or other regulated use cases.
5. What AgeEvidence Does and Does Not Do (No Over-Promises)
Depending on the Verification level, the Services may perform:
- client-side document presence/quality checks (e.g., framing/coverage)
- OCR keyword/field extraction signals
- face detection and quality checks
- liveness challenges (e.g., blink / head-turn sequences)
- anti-spoofing signals (e.g., replay/print/screen-fraud indicators)
- face matching between ID photo and liveness capture (where applicable)
- manual review for configured tiers
The Services do not perform, unless explicitly agreed in an Order Form:
- government database lookups (passport/DMV registries)
- credit bureau checks
- criminal background checks
- address verification
- sanctions/PEP/AML screening
- third-party identity verification provider checks
6. No Legal Advice; No Compliance Guarantee
The Services do not constitute legal, regulatory, tax, or compliance advice. Customer must obtain its own legal advice. Use of the Services does not guarantee Customer's compliance with any law, regulation, or platform policy and does not prevent enforcement actions, fines, penalties, or claims.
7. Customer Responsibilities (Core Risk Allocation)
Customer is solely responsible for:
- determining legal requirements in all jurisdictions where it operates or is accessible
- configuring verification tiers, thresholds, retries, expirations, and fallbacks
- presenting required notices and obtaining required consents (including explicit biometric consent where required)
- making the final decision to grant/deny access and handling disputes/appeals
- maintaining Customer's content rules, moderation, reporting, and enforcement
- securing Customer systems and API keys
8. Verification Limitations; Non-Reliance
Verification Results depend on the information provided by End Users, capture conditions, device/network factors, spoofing attempts, and other variables. Results may be incomplete or inaccurate.
Customer must not rely on any single Verification Result as a guarantee of identity, age, legality of content, or legal compliance. Customer remains responsible for its use case and downstream decisions.
9. End User Misuse, Fraud, and Consequences
Customer must ensure End Users are prohibited from submitting falsified documents, using another person's identity, or bypassing verification controls. AgeEvidence may suspend or block verifications associated with suspected fraud, abuse, or security risk.
Customer acknowledges that remedies against individual End Users (including indemnities) may be limited or impractical to enforce, and Customer remains responsible for implementing appropriate risk controls.
10. Data Processing; DPA
Our processing of personal data is described in our Privacy Policy. Where we act as a processor on Customer's behalf, the parties will enter into a Data Processing Agreement ("DPA").
Customer represents and warrants it has all required rights, notices, and consents to provide Customer Data to the Services and to instruct AgeEvidence to process End User data.
11. Record-Keeping and 2257-Supporting Workflows (If Enabled)
If Customer enables record-keeping workflows (including those intended to support adult content compliance), Customer remains solely responsible for determining whether Customer is a "producer" or has record-keeping, labeling, inspection, or related obligations under applicable law, and for ensuring those obligations are met.
AgeEvidence may provide tooling to store and retrieve verification artifacts (e.g., identity data, audit trails, media) for Customer's configured retention periods. This does not constitute a compliance guarantee.
12. Accounts, Credentials, and Security
- Customer must keep credentials confidential and secure.
- Customer is responsible for all activity under its account and credentials.
- Customer must notify us promptly of suspected compromise.
We may suspend credentials to address compromise, abuse, or security risk.
13. Availability; Changes
The Services are provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation. Maintenance, incidents, and third-party outages may occur.
We may modify, deprecate, or discontinue features. Any SLA/uptime commitments apply only if explicitly agreed in an Order Form.
14. Intellectual Property
AgeEvidence retains all rights in the Services and related IP. Customer receives a limited, non-exclusive, non-transferable license to use the Services during the term for Customer's internal business purposes, subject to these Terms and any Order Form.
15. Disclaimer of Warranties
To the maximum extent permitted by law, the Services and all Verification Results are provided "as is" and "as available" without warranties of any kind, including accuracy, fitness for a particular purpose, non-infringement, or that the Services will be uninterrupted, secure, or error-free.
16. Limitation of Liability
To the maximum extent permitted by law, AgeEvidence will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits/revenue, loss of business, reputational harm, regulatory enforcement, fines, penalties, or procurement of substitute services.
To the maximum extent permitted by law, AgeEvidence's total aggregate liability arising out of or related to the Services will not exceed the fees paid by Customer to AgeEvidence in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law (e.g., fraud or wilful misconduct where non-waivable).
17. Indemnification (Protecting the Company and Its People)
Customer agrees to indemnify, defend, and hold harmless AgeEvidence, its affiliates, and its and their officers, directors, employees, contractors, and shareholders from and against third-party claims, damages, losses, liabilities, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Customer's platform, content, business model, or access decisions
- Customer's breach of these Terms or applicable law
- Customer's failure to provide notices/obtain consents (including biometric consents where required)
- disputes involving Customer and End Users (including allegations of minor access, fraud, or unlawful content)
19. Suspension and Termination
We may suspend or terminate access immediately if we reasonably believe Customer's use poses a security risk, violates these Terms, is unlawful, or could cause harm to us or others.
Either party may terminate according to the applicable Order Form, or if none, with 30 days written notice.
20. Governing Law and Venue
These Terms are governed by the laws specified in the applicable Order Form. If no Order Form specifies governing law, these Terms are governed by the laws of the jurisdiction where the AgeEvidence contracting entity is incorporated, without regard to conflict of law principles.
Exclusive venue for disputes is the courts located in the registered seat of the AgeEvidence contracting entity, unless mandatory law requires otherwise.
